If someone is in immediate danger, call 112 or your local emergency number first. SimTX is a simulation, and nobody monitors simulated distress calls.
To report something, use the report form or email [email protected]. You don't need an account. If you're signed in to the app, you can also report from there.
What you can report
You can report anything on SimTX that you think is illegal under EU law or the law of an EU country. You can also report anything that breaks our terms or community rules. That covers live transmissions, callsigns, station and satellite names, profiles, catalog items and the wiki. For something posted in our Discord server, tell a moderator there or use Discord's own reporting tools.
How to report
Transmissions aren't recorded, so report quickly and give the exact frequency and time.
With the report form
Say where it is. That can be a callsign or a frequency and time, a profile, a catalog item, or a link. Say what happened, and why you think it's illegal or against the rules. Then confirm that you believe in good faith that your notice is accurate and complete. Your name and email address are optional.
When you send it, the page shows a reference number starting with N-. That's your confirmation that we've received the notice, so keep it. We don't send a confirmation email.
Report form
No account needed. Signed in, you skip the contact details and can follow what happens.
Open the report formIn the app
If you're signed in, use Report on a station, in the Receive view while you're receiving, or from the command palette. You can report something you heard in the last 7 days.
By email
Email [email protected] with "Report" in the subject. For your email to count as a notice of illegal content under the Digital Services Act, include:
- why you think the content is illegal, naming the law or right concerned if you can
- exactly where it is: the callsign, a link to the station, profile, catalog item or wiki page, the frequency and mode, the date and time in UTC, or the server
- your name and email address, which you can leave out if you're reporting sexual content involving minors
- a statement that you believe in good faith that the information in your notice is accurate and complete
If your email is a notice of illegal content, we'll reply to confirm we've received it.
Copyright
If something on SimTX violates your copyright, related rights or trademark rights, you have two options.
Informal notice
Use the form, with the category set to copyright, or email [email protected]. Tell us which work or right is being violated, and where. Also tell us that you're the rights holder, or that you're authorised to act for them. Use this route for live transmissions. Live audio isn't stored, so we act by disconnecting or restricting the transmitter.
Formal notice under Hungarian law (Ekertv. § 13)
For content we store, you can use the formal procedure in § 13 of the Hungarian e-commerce act. Content we store includes catalog items, station and profile text, antenna model files and wiki pages.
The notice must be a document with full probative force, for example one signed with a qualified electronic signature, or a public document.
The notice must:
- say what the infringement is, and give the facts that make it probable
- identify the infringing content, for example by its address
- give your name, address or seat, phone number and email address
If an agent acts for you, attach their power of attorney in the same form. Send the notice to [email protected]. A document with a qualified electronic signature can go by email. To send it on paper, ask us for our postal address.
What happens next:
- Within 12 hours of receiving a valid notice, we remove the content or block access to it.
- Within 3 working days, we tell the user who provided the content, in writing. We also tell them whose notice led to the removal.
- The user can object within 8 days, in a document with full probative force. The objection must identify the content and where it was. It must give the user's name, address and other contact details, and explain why the content doesn't infringe. We send the objection, with those details, to you.
- If the user objects, we restore the content without delay, unless a court or authority has ordered the removal.
- If you go to court or file a criminal complaint within 10 working days of receiving the objection, the court's orders decide what happens next. If a court orders interim measures, we remove or block the content again within 12 hours of receiving the order. We tell the user within 1 working day.
Content that violates a minor's personality rights
Hungarian law (Ekertv. § 13(13) to (15)) has a similar procedure for content that violates a minor's personality rights. The minor's legal representative can use it, and so can a minor aged 14 to 17. Send us an electronic notice that lets us identify you and explains why the content violates the minor's rights. Unless we find that the claim has no basis, we remove or block the content within 12 hours. We tell the user within 1 working day. If we don't act, or we refuse, the minor or their representative can turn to the Child Protection Internet Roundtable (Gyermekvédelmi Internet-kerekasztal) at NMHH.
What happens after you report
If the content is illegal or breaks our rules, we remove or restrict it, or take one of the measures in our terms. For illegal content, we do this without undue delay.
If you sent a notice of illegal content and gave us an email address, we tell you what we decided. We also tell you whether we used any automated means, and how you can challenge the decision.
The privacy policy, section 2.6, explains how we handle your report and the details in it, including who sees them. The privacy policy, section 8, says how long we keep them.
Statements of reasons
When we warn you, restrict or suspend your account, disconnect you, or remove or hide your content, we give you a statement of reasons, as the Digital Services Act requires. It says:
- what we did, how far it goes and for how long
- the facts we relied on, and whether we acted on a notice or on our own initiative
- whether automated means were involved
- which law, or which rule in our terms or community rules, was broken
- how to ask us to look again, and the other options
The full statement is on the Restrictions page in the portal (simtx.net/app/restrictions), and in your data download. You can open the Restrictions page even while your account is suspended. If you're disconnected, the app shows a short reason at once. While your account is active, statements about disconnects and restrictions also appear in the app. If you can't sign in, write to [email protected] and we'll send you a copy.
We might not give a statement where the law forbids it, for example when an authority's order tells us not to. We also might not give one where we have no way to reach you, such as when you use the public receiver without an account.
Asking us to look again
If you think a decision about you or your content is wrong, email [email protected] within 6 months. You can do the same if you reported something and disagree with what we did. Say what was decided and why you think it's wrong. Include the reference on the statement or notice, or your handle or callsign. A person looks at it, and if we got it wrong, we undo the decision.
You don't have to ask us first. You can complain at any time to Hungary's Digital Services Coordinator, the National Media and Infocommunications Authority (NMHH, nmhh.hu). You can also complain to the Digital Services Coordinator of the EU country where you live, or go to court. For questions about your data, see the privacy policy, section 15.
